Most companies are pretty protective of their names. You would tend to think the biggest, Allstate Insurance Company would have filed a lawsuit against every one of these to protect against fraudulent use of their name.

In Indiana there are only 85 companies containing the word Allstate or some variation of it. Of course the one everyone knows with the good hands is Allstate Insurance Company. They too have an Allstate Construction Company, and an Allstate Construction. But there are lots of other types of companies using that name. I think you get my drift here. There are lots of Allstate companies, but there is only One Allstate Insurance Company, the good hands people in Indiana, Alabama, Texas and Ohio that Michael Kent Plambeck recognizes.

Allstate Insurance Company filed $3.8 million medical fraud lawsuit against Six Physicians and five medical professional corporations in May of 2013. The complaint was filed in the United States District Court for the Eastern District of New York against the following defendants: Targee Medical Services, P.C., Allmed Medical of Williamsburg, P.C., Flatlands Medical, P.C., Michael Alleyne Medical Doctor, P.C., VAS Medical, P.L.L.C., Conrad Robert Williams, M.D., Michael I. Bley,
M.D., Barry Alan Dublin, M.D., Michael George Alleyne, M.D., Victor R. Sharobeem, M.D., and Marat Tsirlin, M.D., but did not include Michael K Plambeck. Since 2003, Allstate has filed 47 fraud lawsuits in New York State seeking more than $235 million in damages, but not a penny against Michael Kent Plambeck DC.

According to Allstate’s news release on May 16, 2013, it alleges that the defendants routinely submitted fraudulent billing for medical examinations and diagnostic tests that never were performed, were not performed in accordance with basic, legitimate medical standards, and/or were not intended to benefit the patients who purportedly were subjected to them.

According to the Insurance Information Institute, no-fault fraud is costing New Yorkers millions of dollars year-after-year. "In essence, honest hardworking New Yorkers are paying a "fraud tax," said Allison McMahon, Allstate spokesperson. "We need lawmakers to enact meaningful insurance reform that puts the citizens of New York first."

One study by the American Association for Justice called Allstate Insurance Company one of the 10 worst insurance companies in America. So I guess it makes you wonder who the fraudsters really are.

Allstate seems to regularly sue chiropractors and medical doctors, and even some attorneys. They decided to go after multidisciplinary practice in New Jersey winning a large judgment award of $3.9 million. According to one website, chirobase.org, the key question in looking at "integrated" MD/DC practices is whether they are used to provide unnecessary services. I have no way to determine how many of Dahan's clients have engaged in abusive billing. But documents from this lawsuit makes it clear that they have the tools to do so [5,6].
